Reserves Policy

ALL new reserve requests need to be submitted in writing using one of the following three forms:

  • Library Materials Reserve Forms (for books or audio-visual material owned by the library or the professor)
    • Online (for a single item at a time)
    • Print (for multiple items)
  • Duplicated Materials Reserve Form (for photocopied articles, student work, etc.)

Copyright Policy

The Library adheres to Section 107 of the Copyright Act, the Fair Use Doctrine, as the guiding principle behind the Course Reserves Collection.

Section 107. Limitations on exclusive rights: Fair Use Not withstanding the provisions of sections 106 [Exclusive rights in copyrighted works] and 106A [Rights of certain authors to attribution and integrity], the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified in that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship or research, is not an infringement of copyright.

In determining whether the use made of a photocopied work in any particular case is a fair use the factors to be considered shall include:

  1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
  2. the nature of the copyrighted work;
  3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
  4. the effect of the use upon the potential market for or value of the copyrighted work.

Reserve Items NOT Requiring Copyright Clearance

  • original copies of lawfully acquired books, complete issues of journals, and video and sound recordings, including those owned by the professor;
  • unpublished works created by the instructor such as old exams, lecture notes, syllabi, etc;
  • works created by the U.S. Government; and
  • works in the public domain.

Reserve Items Requiring Copyright Clearance: Duplicated Materials and Student Work

  • Photocopies of copyrighted materials will be placed on reserve without obtaining copyright permission so long as they do not exceed the guidelines listed below:
    • first time use of material by that professor for that particular course;
    • one journal or newspaper article from a single issue;
    • one chapter of a book;
    • a prose excerpt that does not exceed 10% of the total work; and
    • One chart, graph, diagram, drawing, cartoon or picture from one book or journal issue.
  • Student papers and other student-created materials must be accompanied by the FERPA Release Form.

General Reserve Policies

  • Reserves are processed on a first-come, first-served basis.
  • Reserves received at least one week prior to the beginning of class are guaranteed to be on reserve by the first day of class, provided the item is in the library upon receipt of the request.
  • Personal copies of reserve items will be returned to your campus mailbox at the end of the semester(s) for which you requested the reserve. Items belonging to the library will be reshelved.
